General
This Agreement, sets forth the terms and conditions that apply to use of this siteand all sub sites that reside under the site (collectively,”Rashtriya Janbhavna Sites”), by a Subscriber. “Subscriber” means each person who establishes or accesses a connection (“Account”) for access to and use of the Rashtriya Janbhavna Sites.
Restrictions on use
The Rashtriya Janbhavna Sites are owned and operated by Rashtriya Janbhavna (“the Company”),an Rashtriya Janbhavna group company, and contains material which is derived in whole or in part from material supplied by the Company,its group companies, various news agencies and other sources (including content partners), and is protected by international copyright and trademark laws. The restrictions on use of the material and content on the Rashtriya Janbhavna Sites by the Subscriber are specified below. . Except where specifically authorised, the Subscriber may not modify, copy, reproduce, republish, upload, post, transmit or distribute in any way any material from the Rashtriya Janbhavna Sites including code and software.
By using the Rashtriya Janbhavna Sites (other than to read this Agreement for the first time), Subscriber agrees to comply with all of the terms and conditions hereof. The right to use the Rashtriya Janbhavna Sites is personal to Subscriber and is not transferable to any other person or entity. Subscriber is responsible for all use of Subscriber’s Account (under any screen name or password) and for ensuring that all use of Subscriber’s Account complies fully with the provisions of this Agreement. Subscriber shall be responsible for protecting the confidentiality of Subscriber’s password(s), if any.
The Company shall have the right at any time to change or discontinue any aspect or feature of Rashtriya Janbhavna Sites, including, but not limited to, content, hours of availability and equipment needed for access or use.

Changed Terms
The Company shall have the right at any time to change or modify the terms and conditions applicable to Subscriber’s use of the Rashtriya Janbhavna Sites, or any part thereof, or to impose new conditions, including but not limited to, adding fees and charges for use. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means including but not limited to, posting on the Rashtriya Janbhavna Site, or by electronic or conventional mail, or by any other means by which Subscriber obtains notice thereof. Any use of the Rashtriya Janbhavna Site by Subscriber after such notice shall be deemed to constitute acceptance by Subscriber of such changes, modifications or additions.
Equipment
Subscriber shall be responsible for obtaining and maintaining all telephone, computer hardware and other equipment needed for access to and use of the Rashtriya Janbhavna Sites and all charges related thereto.
Subscriber Conduct
Subscriber shall use the Rashtriya Janbhavna Sites for lawful purposes only. Subscriber shall not post or transmit through the Rashtriya Janbhavna Sites any material which violates or infringes in any way upon the rights of others, which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, which encourages conduct that would constitute a criminal offence, give right to civil liability or otherwise violate any law, or which, without the Company’s express prior approval, contains advertising or any solicitation with respect to products or services. Any conduct by a Subscriber that in the Company’s discretion restricts or inhibits any other Subscriber from using or enjoying Rashtriya Janbhavna Sites will not be permitted. Subscriber shall not use Rashtriya Janbhavna Sites to advertise or perform any commercial solicitation, including, but not limited to, the solicitation of users to become subscribers of other on-line information services competitive with the Rashtriya Janbhavna Sites. Rashtriya Janbhavna Sites contains copyrighted material, trademarks and other proprietary information, including, but not limited to, text, software, photos, video, graphics, music or sound, and the entire contents of Rashtriya Janbhavna Sites are copyrighted as a collective or severable work under applicable copyright laws. The Company and/or its affiliates own or have acquired a copyright in the selection, coordination, arrangement and enhancement of such content, as well as in the content original to it. Subscriber may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the content, in whole or in part. Subscriber may download copyrighted material for Subscriber’s personal use only. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without the express permission of the Company and the copyright owner. In the event of any permitted copying, redistribution or publication of copyrighted material, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made. Subscriber acknowledges that it does not acquire any ownership rights by downloading copyrighted material.
Subscriber shall not upload, post or otherwise make available on the Rashtriya Janbhavna Sites any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right and the burden of determining that any material is not protected by copyright rests with Subscriber. Subscriber shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission. By submitting material to any public area of Rashtriya Janbhavna Sites, Subscriber automatically grants, or warrants that the owner of such material has expressly granted the Company the royalty fee, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate and distribute such material (in whole or in part) worldwide and/or to incorporate it in other works in any form, media or technology now known or hereafter developed for the full term of any copyright that may exist in such material. Subscriber also permits any other Subscriber to access, view, store or reproduce the material for that Subscriber’s personal use. Subscriber hereby grants the Company the right to edit, copy, publish and distribute any material made available on Rashtriya Janbhavna Sites by Subscriber.
The foregoing provisions are for the benefit of the Company, its subsidiaries, affiliates and its third party content providers and licensors and each shall have the right to assert and enforce such provisions directly or on its own behalf.
Disclaimer of Warranty: Limitation of Liability
Subscriber expressly agrees that use of Rashtriya Janbhavna Sites are at Subscriber’s sole risk. Neither the Company, its affiliates nor any of their respective employees, agents, third party content providers or licensors warrant that Rashtriya Janbhavna Sites will be uninterrupted or error free; nor do they make any warranty as to the results that may be obtained from use of Rashtriya Janbhavna Sites, or as to the accuracy, reliability or content of any information, service, or merchandise provided through Rashtriya Janbhavna Sites.
Rashtriya Janbhavna Sites is provided on an “As Is” basis without warranties of any kind, either express or implied, including, but not limited to, warranties of title or implied warranties of merchantability or fitness for a particular purpose, other than those warranties which are implied by and incapable of exclusion, restriction or modification under the laws applicable to this agreement.
This disclaimer of liability applies to any damages or injury, caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortious behavior, negligence, or under any other cause of action. Subscriber specifically acknowledges that the Company is not liable for the defamatory, offensive or illegal conduct of other subscribers or third-parties in cases including but not limited to any interactive communication on or through the sites and that the risk of injury from the foregoing rests entirely with subscriber(s).
In no event will the Company, or any person or entity involved in creating, producing or distributing Rashtriya Janbhavna Sites or the Rashtriya Janbhavna Sites software, be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential or punitive damages arising out of the use of or inability to use Rashtriya Janbhavna Sites. Subscriber hereby acknowledges that the provisions of this section shall apply to all content on Rashtriya Janbhavna Sites.
In addition to the terms set forth above neither, the Company, not its affiliates, information providers or content partners shall be liable regardless of the cause or duration, for any errors, inaccuracies, omissions, or other defects in, or untimeliness or unauthenticity of, the information contained within Rashtriya Janbhavna Sites, or for any delay or interruption in the transmission thereof to the user, or for any claims or losses arising therefrom or occasioned thereby. None of the foregoing parties shall be liable for any third-party claims or losses of any nature, including, but not limited to, lost profits, punitive or consequential damages. Prior to the execution of a stock trade, subscribers are advised to consult with your broker or other financial representative to verify pricing or other information. The Company, its affiliates, information providers or content partners shall have no liability for investment decisions based on the information provided. Neither, the Company, nor its affiliates, information providers or content partners warrant or guarantee the timeliness, sequence, accuracy or completeness of this information.

Rashtriya Janbhavna and its affiliates and subsidiaries (collectively, “Rashtriya Janbhavna ”, “we” or “us”) are engaged in the business of publishing news and current affairs content through their websites, mobile applications, and other mediums.
This Policy outlines our practices in relation to the collection, storage, usage, processing, and disclosure of personal data that you have consented to share with us when you access, use, or otherwise interact with our Platform.
At Rashtriya Janbhavna , we are committed to protecting your personal data and respecting your privacy. In order to provide you with access to and use of the Platform, we have to collect and otherwise process certain data about you. This Policy explains how we process and use personal data about you.

(b) We also collect, use, and share aggregated data such as statistical or demographic data for any purpose. Aggregated data could be derived from your personal data but is not considered personal data under law as it does not directly or indirectly reveal your identity. However, if we combine or connect aggregated data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this Policy.
(c) What happens if I refuse to provide my personal data?
Where we need to collect personal data by law, or under the terms of a contract (such as the Terms), and you fail to provide that data when requested, we may not be able to perform the contract (for example, to provide you with the Platform). In this case, we may have to cancel or limit your access to the Platform.

This is to provide the Platform to you and ensure that you are aware of all the features of the Platform and for related purposes.
(c) You agree and acknowledge that any and all information pertaining to you, whether or not you directly provide it to us (via the Platform or otherwise), including but not limited to personal correspondence such as emails, instructions from you, etc., may be collected, compiled, and shared by us in order to render the Platform to you. This may include but not be limited to social media companies, third-party service providers, storage providers, data analytics providers, consultants, lawyers, and auditors. We may also share this information with other entities in the Rashtriya Janbhavna group in connection with the above-mentioned purposes.
(d) You agree and acknowledge that we may share data without your consent when it is required by law or by any court or government agency or authority to disclose such information. Such disclosures are made in good faith and belief that it is reasonably necessary to do so for enforcing this Policy or the Terms, or in order to comply with any applicable laws and regulations.
5. COOKIES
(a) Cookies are small files that a site or its service provider transfers to your device’s hard drive through your web browser (if you permit it to) that enables the sites or service providers’ systems to recognise your browser and capture and remember certain information.

analytic service providers and advertising networks that conduct web analytics for us to help us improve the Platform. These analytics providers may use cookies and other technologies to perform their services;
other registered users on our Platform upon your request or where you explicitly consent to such disclosure, unless otherwise required by law; and regulators and other bodies, as required by law or regulation.
(b) We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.
7. YOUR RIGHTS IN RELATION TO YOUR PERSONAL DATA
(a) Access and Updating your Personal Data: When you use our Platform, we make best efforts to provide you with the ability to access and correct inaccurate or deficient data, subject to any legal requirements.
(b) Opting-out of Marketing and Promotional Communications: When we send you marketing and promotional content through email, we make best efforts to provide you with the ability to opt-out of such communications by using the opt-out instructions provided in such emails.
8. TRANSFERS OF YOUR PERSONAL DATA
(a) We comply with applicable laws in respect of storage and transfers of personal data. As a part of your use of the Platform, the information, and personal data you provide to us may be transferred to and stored in countries other than the country you are based in. This may happen if any of our servers are from time to time located in a country other than the one you are based in, or one of our service providers is located in a country other than the one you are based in.
(b) By submitting your information and personal data to us, you agree to the transfer, storage, and processing of such information and personal data in the manner described above.
9. DATA SECURITY
(a) We implement certain security measures and privacy-protective features on our Platform to protect your personal data from unauthorised access and disclosure, and follow standards prescribed by applicable law.
(b) Where you have chosen a password that enables you to access certain parts of the Platform, you are responsible for keeping this password secret and confidential. We will not be responsible for any unauthorised use of your information, or for any lost, stolen, or compromised passwords, or for any activity on your user account due to such unauthorised disclosure of your password. In the event your password has been compromised in any manner whatsoever, you should promptly notify us to enable us to initiate a change of password.
10. DATA RETENTION
(a) You agree and acknowledge that your personal data will continue to be stored and retained by us for as long as necessary to fulfil our stated purpose(s) and for a reasonable period after either the termination of your account on the Platform to comply with our legal rights and obligations.
(b) In some circumstances, we may aggregate your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.
11. BUSINESS TRANSITIONS
In the event we go through a business transition, including but not limited to a merger, acquisition by another organisation, or sale of all or a portion of our assets, your personal data might be among the assets transferred.
12. USER GENERATED INFORMATION
(a) We invite Users to submit feedback and suggestions, make service requests, and submit details of grievances on the Platform. Please note that such content may be available to visitors to our Platform.
(b) We cannot prevent User Information from being used in a manner that is contrary to this Policy, applicable laws, or your personal privacy, and we disclaim all liability (express or implied) in this regard. Further, you agree to comply with all applicable laws in relation to the content uploaded or otherwise shared and received by you on our Platform. You understand and acknowledge that you will be solely responsible for any information published by you on our Platform that violates applicable laws.
13. UPDATES TO THIS POLICY
(a) We may occasionally update this Policy. If we make changes to this Policy, we will upload the revised policy on the Platform or share it with you through other means, such as email. To the extent permitted under applicable law, by using our Platform after such notice, you consent to updates made to this Policy.
These terms and conditions (“Terms”) govern the access to, or use of the services made available through this website and the Rashtriya Janbhavna mobile application (collectively the “Platform”).
These Terms constitute a binding and enforceable legal contract between New Delhi Television Limited, a company incorporated under the Companies Act, 1956, with its registered address at B-50 A, 2nd Floor Archana Complex Greater Kailash I, New Delhi 110048, and its affiliates, successors, and assigns (“Rashtriya Janbhavna ”, “we”, or “us”) and any user of the Platform (“you” or “User”). You represent and warrant that you have full legal capacity and authority to agree and bind yourself to these Terms.
By using the Platform, you agree that you have read, understood, and are bound by these Terms, and that you comply with the requirements listed herein. If you do not agree to all of these Terms or comply with the requirements herein, please do not access the Platform.
These Terms also include terms, policies, and disclaimers issued by us from time to time (“Additional Terms”). In the event of a conflict between these Terms and the Additional Terms, the Additional Terms will prevail.
1.PLATFORM
oThe Platform includes the provision of news and current affairs content and other affiliated services to Users and allows Users to access and view content posted or published by Rashtriya Janbhavna on a real-time basis.
oIn the event you choose to avail any of Rashtriya Janbhavna ’s additional features or functions (“Additional Services”), you shall be bound by the terms of such Additional Services in addition to these Terms. The Additional Services may require the User to purchase certain features and benefits through the Platform. In the event of a conflict between these Terms and the terms of such Additional Services, the latter shall prevail.
2.ACCOUNT CREATION
oTo avail the full features of the Platform, you will be required to create an account. To create an account, you may be required to furnish certain details, including but not limited to your name and email addresses.

oYou are solely responsible for maintaining the security and confidentiality of your username and password and agree to immediately notify Rashtriya Janbhavna of any disclosure or unauthorised use of your account or any other breach of security with respect to your account.
oYou expressly agree to be liable and accountable for all activities that take place through your account. Rashtriya Janbhavna shall in no manner be held liable for any unauthorised access to or use of such accounts.
oYou agree to receive communications from Rashtriya Janbhavna regarding: (i) information relating to transactions recorded on the Platform; (ii) information about Rashtriya Janbhavna and the Platform; (iii) promotional offers and services from Rashtriya Janbhavna and its third-party partners, and (iv) any other matter in relation to the Platform.
3.THIRD PARTY SERVICES
oThe Platform may include services, content, documents, and information owned by, licensed to, or otherwise made available by a third party, including the single sign-on feature (“Third Party Services”) or contain links to Third Party Services. You understand that Third Party Services are the responsibility of the third party that created or provided it and acknowledge that use of such Third Party Services is solely at your own risk.
oRashtriya Janbhavna makes no representations and excludes all warranties and liabilities arising out of or pertaining to such Third Party Services, including their accuracy or completeness. Further, all intellectual property rights in and to Third Party Services are the property of the respective third parties.
4.USER RESPONSIBILITIES
oYou represent and warrant that all information that you provide or make available through or in relation to the Platform is complete, true, and correct on the date of agreeing to these Terms and shall continue to be complete, true, and correct and shall remain accurate in all respects. Should any information that you provide change during the existence of these Terms, you warrant to immediately bring such change to Rashtriya Janbhavna ’s notice. Rashtriya Janbhavna does not accept any responsibility or liability for any loss or damage that you may suffer or incur if any information, documentation, material, or data provided to avail the Platform is incorrect, incomplete, inaccurate, or misleading, or if you fail to disclose any material fact.
oYou shall be solely responsible for ensuring compliance with laws that apply to your use of the Platform and solely liable for any liability that may arise due to a breach of your obligations in this regard.
oYou shall extend all cooperation to Rashtriya Janbhavna in its defence of any proceedings that may be initiated against it due to a breach of your obligations or covenants under these Terms.
oYou shall not use the Platform in any manner except as expressly permitted in these Terms. Without limiting the generality of the preceding sentence, you may not:
infringe any proprietary rights, including but not limited to copyrights, patents, trademarks, or trade secrets, of any party;
except as may be provided hereunder, copy, display, distribute, modify, publish, reproduce, store, transmit, post, translate, create any derivative works from, or license the Platform;
use the Platform to transmit any data or send or upload any material that contains viruses, Trojan horses, worms, timebombs, keystroke loggers, spyware, adware, or any other harmful programmes or similar computer code designed to adversely affect the operation of any computer software or hardware;
use any robot, spider, other automated device, or manual process to monitor or copy the Platform or any portion thereof;
engage in the systematic retrieval of content from the Platform to create or compile, directly or indirectly, a collection, compilation, database or directory;
use the Platform in (A) any unlawful manner, (B) for fraudulent or malicious activities, or (C) in any manner inconsistent with these Terms;
violate applicable laws in any manner; or
host, display, upload, modify, publish, transmit, store, update or share any information that (A) belongs to another person and to which you do not have any right; (B) is defamatory, obscene, pornographic, paedophilic, invasive of another’s privacy, including bodily privacy, insulting or harassing on the basis of gender, libellous, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or otherwise inconsistent with or contrary to the laws in force; (C) is harmful to children; (D) infringes any patent, trademark, copyright or other proprietary rights; (E) violates any law for the time being in force; (F) deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any information which is patently false or misleading in nature but may reasonably be perceived as a fact; (G) impersonates another person; (H) threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order, or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting other nation; (I) contains software virus or any other computer code, file, or programme designed to interrupt, destroy, or limit the functionality of any computer resource; or (J) is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person
5.PAYMENTS
Rashtriya Janbhavna does not presently charge you any fees to access and use the Platform. However, Rashtriya Janbhavna reserves the right to charge you for Additional Services as detailed on the Platform.
8.INTELLECTUAL PROPERTY
o All rights, title, and interest in and to the Platform, including all intellectual property rights arising out of the Platform, are owned by or otherwise licensed to Rashtriya Janbhavna . Subject to compliance with these Terms, Rashtriya Janbhavna grants you a non-exclusive, non-transferable, non-sub licensable, revocable, and limited licence to access and use the Platform in accordance with these Terms and its written instructions issued from time to time
oYou may submit or make available to Rashtriya Janbhavna content, videos, information, URLs, contact information, photos, and any other information, whether or not created originally by you (“User Information”). You are solely responsible for such User Information, and hereby warrant that you have all necessary rights, licences, title, and consents to make available User Information to Rashtriya Janbhavna , and that the provision of such User Information to Rashtriya Janbhavna shall not violate any third-party rights.
oThe User hereby grants to Rashtriya Janbhavna a royalty-free, perpetual, irrevocable, non-exclusive, fully sublicensable right and licence to copy, modify, display, distribute, perform, create derivative works from, store and otherwise use and exploit, all User Information, in any form through any media, software, or technology, in connection with: (a) providing Users the Platform; or (b) making available User Information on or in connection with the websites and other properties owned and operated by Rashtriya Janbhavna . Rashtriya Janbhavna makes no claim to any ownership interest in the User Information obtained from a User under these Terms, and no ownership rights will be transferred under this Agreement.
oRashtriya Janbhavna may request you to, or you may submit suggestions, testimonials, and other feedback relating to the Platform from time to time (“Feedback”). Rashtriya Janbhavna may freely use, copy, disclose, publish, display, distribute, and exploit the Feedback without any payment of royalty, acknowledgement, prior consent, or any other form of restriction arising out of your intellectual property rights.
oExcept as expressly stated in these Terms, nothing in these Terms should be construed as conferring any right in or licence to Rashtriya Janbhavna ’s or any third party’s intellectual rights
9.TERM AND TERMINATION
oThese Terms shall remain in effect unless terminated in accordance with the terms hereunder.
oRashtriya Janbhavna may terminate your access to or use of the Platform, or any portion thereof, immediately and at any point, at its sole discretion if you violate or breach any of your obligations, responsibilities, or covenants under these Terms.

oUpon termination under Clause 7(b):

10.DISCLAIMERS AND WARRANTIES
oThe use of the Platform is at your sole risk.
oRashtriya Janbhavna does not represent you in any fiduciary, agent, attorney-client, or any other capacity whatsoever and the use of the Platform does not create, by implication or otherwise and without limitation, any fiduciary duty, attorney-client relationship, representation, or any other sort of professional relationship or representation whatsoever. The Platform does not constitute legal advice. Any information provided by Rashtriya Janbhavna , or its employees, contractors, or other personnel is solely for informational purposes and are not legal advice and should not be treated as such.
oTo the extent permitted by applicable law, the Platform is provided on an “as is” and “as available” basis. Rashtriya Janbhavna does not warrant that the operation of the Platform will be uninterrupted or error free or that the functions contained in the Platform will meet your requirements. We may suspend or withdraw any or all parts of the Platform at any time without notice to you.
oTo the fullest extent permissible under applicable law, Rashtriya Janbhavna expressly disclaims all warranties of any kind, express or implied, arising out of the Platform, including warranties of merchantability, fitness for a particular purpose, satisfactory quality, accuracy, title and non-infringement, compatibility, applicability, usability, appropriateness, and any warranty that may arise out of course of performance, course of dealing, or usage of trade.
oYou hereby accept full responsibility for any consequences that may arise from your use of the Platform, and expressly agree and acknowledge that Rashtriya Janbhavna shall have absolutely no liability with respect to the same.
oTo the fullest extent permissible by law, Rashtriya Janbhavna and its related parties each disclaim all liability for any loss or damage arising out of or due to:
your use of, inability to use, or availability or unavailability of the Platform or User Information, including any Third Party Services;
the occurrence or existence of any defect, interruption, or delays in the operation or transmission of information to, from, or through the Platform, communications failure, theft, destruction or unauthorised access to Rashtriya Janbhavna ’s records, programmes, services, server, or other infrastructure relating to the Platform; or
the failure of the Platform to remain operational for any period of time.
oNotwithstanding anything to the contrary contained herein, neither Rashtriya Janbhavna nor any of its related parties shall have any liability to you or any third party for any indirect, incidental, special, or consequential damages or any loss of revenue or profits arising under, directly or indirectly, or relating, in any manner whatsoever, to these Terms or the Platform. To the maximum extent permitted by law, you agree to waive, release, discharge, and hold harmless Rashtriya Janbhavna , its affiliated and subsidiary companies, its parent companies, and each of their directors, officers, employees, and agents, from any and all claims, losses, damages, liabilities, expenses and causes of action arising out of the Platform.
oRashtriya Janbhavna strives to primarily publish and disseminate news and current affairs content. Except as otherwise required by applicable laws, Rashtriya Janbhavna performs no technical, legal, financial, or any other type of due diligence on such and makes no representations or warranties in this regard. Rashtriya Janbhavna does not guarantee whether a particular news or current affairs content on the Platform is suitable for or will meet the expectations of Users. Rashtriya Janbhavna is not responsible for the truthfulness, accuracy, or completeness of such news and current affairs content.
oAny material or information provided, shared, or otherwise available through the Platform is for informational purposes only. You should not rely upon such material or information for making any business, legal, medical, financial, or other decisions. Any reliance you place upon such material or information is therefore strictly at your own account and risk. You must obtain professional or specialist advice before taking or refraining from taking any action on the basis of information made available on the Platform.
11.INDEMNITY
oYou shall indemnify, defend at Rashtriya Janbhavna ’s option, and hold Rashtriya Janbhavna , its parent companies, subsidiaries, affiliates, and their officers, associates, successors, assigns, licensors, employees, directors, agents, and representatives, harmless from and against any claim, demand, lawsuits, judicial proceeding, losses, liabilities, damages and costs (including, without limitation, from all damages, liabilities, settlements, costs and attorneys’ fees) due to or arising out of your access to or use of the Platform, violation of these Terms, or any infringement by any third party who may use your account with Rashtriya Janbhavna , of these Terms.
oRashtriya Janbhavna ’s aggregate monetary liability to you shall not exceed INR 1000.
12.CONSENT TO USE DATA
oBy using the Platform, you agree and acknowledge that Rashtriya Janbhavna may collect and process your data in accordance with its privacy policy, available on www.Rashtriya Janbhavna .com/convergence/Rashtriya Janbhavna /new/privacy_policy.aspx
oYou agree that Rashtriya Janbhavna may collect and use your information and technical data and related information.
oRashtriya Janbhavna may use information and data pertaining to your use of the Platform for analytics, trends’ identification, and purposes of statistics to further enhance the effectiveness and efficiency of the Platform.
oSubject to applicable laws, Rashtriya Janbhavna may be directed by law enforcement agencies or the government and related bodies to disclose data in relation to Users in connection with criminal proceedings. You hereby agree and acknowledge that in Rashtriya Janbhavna shall have the right to share such data with relevant agencies or bodies.
13.MODIFICATION
Rashtriya Janbhavna reserves the right to, at any time, add, modify, or discontinue, temporarily or permanently, the Platform (or any part thereof) with or without cause. Platform shall not be liable for any such addition, modification, suspension, or discontinuation of the Platform.
16.GOVERNING LAW, JURISDICTION, AND DISPUTE RESOLUTION
oThese Terms shall be governed by and construed and enforced in accordance with the laws of India. Subject to other provisions in this Clause, courts in New Delhi shall have exclusive jurisdiction over all issues arising out of these Terms or the use of the Platform.
oAny controversies, conflicts, disputes, or differences arising out of these Terms shall be resolved by arbitration in New Delhi in accordance with the Arbitration and Conciliation Act, 1996 for the time being in force, which is deemed to be incorporated by reference in this Clause. The tribunal shall consist of 1 (One) arbitrator appointed by us. The language of the arbitration shall be English.
oThe parties to the arbitration shall keep the arbitration confidential and not disclose to any person, other than on a need-to-know basis or to legal advisors, unless required to do so by law. The decision of the arbitrator shall be final and binding on all the Parties hereto.
oEach party to the arbitration shall bear its own costs with respect to any dispute.
17.MISCELLANEOUS PROVISIONS
oModification of Terms: Rashtriya Janbhavna reserves the right at any time to modify these Terms and to add new or additional terms or conditions on the access to or use of the Platform. Such modifications and additional terms and conditions will be communicated to you. In the event you refuse to accept such changes, these Terms will terminate.

oSeverability: If any provision of these Terms is determined by any court or other competent authority to be unlawful or unenforceable, the other provisions of these Terms will continue in effect. If any unlawful or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect (unless that would contradict the clear intention of the clause, in which case the entirety of the relevant provision will be deemed to be deleted).
oAssignment: You shall not license, sell, transfer, or assign your rights, obligations, or covenants under these Terms in any manner without Rashtriya Janbhavna ’s prior written consent. Rashtriya Janbhavna may grant or withhold this consent in its sole discretion and subject to any conditions it deems appropriate. Rashtriya Janbhavna may assign its rights to any of its affiliates, subsidiaries, or parent companies, or to any successor in interest of any business associated with the Platform without any prior notice to you.
oNotices: All notices, requests, demands, and determinations for Rashtriya Janbhavna under these Terms (other than routine operational communications) shall be sent to legal@Rashtriya Janbhavna .com.
oThird Party Rights: No third party shall have any rights to enforce any terms contained herein.
oWaiver: Any delay in the exercise of rights and remedies available under the Terms does not constitute a waiver of that or any other right or remedy.
oForce Majeure: Rashtriya Janbhavna will have no liability to you if we are prevented or delayed from performing our obligations or carrying out our business by acts, events, or omissions beyond our reasonable control including without limitation strikes, labour disputes, failure of utility service or telecommunications network, act of God, war, riot, civil commotion, malicious damage, or compliance with any law or governmental order, rule, regulation, or direction.
